The Kostroma Regional Court considered the case of community donations to prepare for the end of the world, reports a Novosti44 correspondent. The defendant in this is the founder of the community, the owner of the goose farm Alexander Dostavalov. The applicants are two members of the association.
The plaintiffs, the spouses, reported that the founder of the association was a science fiction writer and “often published articles describing when the End of the World will come, the Earth will turn, the poles will change. ” He believes that to prepare for this event, a community is needed where “everyone is busy with their own business.” First of all, the members of the association talked about the food supply and wanted to improve the goose farm of the founder after they live.
The spouses who went to court voluntarily transferred 230 thousand rubles to the businessman to buy a set of non-perishable products for 4 years. After this, they considered themselves members of society, but their relationship with Dostavalov deteriorated. The plaintiff demanded his money back, but the merchant refused to do so.
The court found that such an association existed. Now there are about 65 people in it, and other followers also contribute to it. In resolving the case, the judge proceeded from the fact that the plaintiff knew that he had not transferred the money by mistake and did not impose any conditions on the defendant for the return. Therefore, from the point of view of the law, it is impossible to call a transfer unjust enrichment. Therefore, based on the results of the consideration of the case, the claim for the recovery of the funds is not satisfied. The judicial act entered into legal force.
