“Inflated” compared to last year is the average tax they are required to pay this year taxpayers with a debit note. The data from the declarations submitted so far show that the average tax has been “obtained” at 1,200 euros, recording an increase of more than 30% compared to last year in the corresponding number of tax declarations debited .
The “jump” in the average tax is linked to the increase in declared income but also to the new presumptive taxation system of the self-employed which this year distributes an additional “charge” of 550 million euros to taxpayers with income from business activity. The “rips” received by professionals are “fire and glory” because more than half are trapped in the trap of imputed income. For example, a hairdresser declared a net profit of 4,927 euros this year and had a tax of 492 euros. The new system, however, produces a minimum net income of 16,257.96 euros, which pushes the tax to 2,276.54 euros, almost five times higher.
Both the Prime Minister Kyriakos Mitsotakis and the Minister of National Economy and Finance Kostis Hatzidakis left an open window for corrections and actions to restore possible injustices in the presumptive taxation system of the self -employed without changing the core of the scale.
Appeal to the Supreme Court
Now, the freelancers and the self-employed have implemented nationwide abstinence from their duties and activities and appealed to the Council of State with a request to cancel the decision of the AADE, related to the definition of the method of against the minimum annual income. and the period of the audit.
The Coordinating Committee of Independent Professionals – Scientists – Professional Artisans and Merchants, requests the annulment of the presumptive income arguing that it is against the constitutional principles of equality of citizens before the public burden, proportionality and the provide full and effective judicial protection, because it treats freelancers as employees, while it is about different categories of taxpayers, because, after all, the SC itself decides. They also argue that challenging the assumption, through the prescribed process of submitting a tax audit, makes the assumption essentially unsustainable and changes the meaning, logic and nature of the tax audit.
